If it becomes necessary to recover an unpaid commercial debt, it is important to be aware of certain characteristics of the Mexican system.<\/p>\n<h2>How to recover a debt from a Mexican debtor<\/h2>\n<p><strong>There is no minimum credit value <\/strong>for initiating legal action: in theory, you can proceed even for small amounts. In practice, however, <strong>it is advisable to consider legal action<\/strong> especially when (or because):<\/p>\n<ul>\n<li><strong>The creditor has good documentary evidence of the debt <\/strong>(contract, invoices, account statements, acknowledgments of debt, commercial correspondence acknowledging the debt) that make the case easy to investigate;<\/li>\n<li><strong>The debtor has assets that can be seized <\/strong>(accounts, property, claims against third parties) or there is a risk that they will be dispersed: in these cases, it may be useful to request <strong>interim measures<\/strong> (e.g., seizure of assets\/credits to support enforcement.<\/li>\n<li><strong>Out-of-court negotiations are not working <\/strong>or the debtor is not cooperating: a letter of formal notice to pay from a lawyer <strong>is not mandatory <\/strong>to start litigation, but it is often recommended because it can facilitate voluntary payment and reduce time\/costs (and is necessary if the obligation does not have a defined deadline, in order to &#8216;put the debtor in default&#8217;).<\/li>\n<li><strong>The cost\/benefit ratio is favorable<\/strong><strong>:<\/strong> an ordinary lawsuit can take <strong>about 12 months from the completion of the notification <\/strong>to obtain a first instance decision; in addition, legal costs can theoretically be charged to the losing party, but <strong>the actual recovery of such costs is not common in practice<\/strong><strong>.<\/strong><\/li>\n<li><strong>You want to interrupt the<\/strong><strong> statute of limitations <\/strong>(generally set at<strong> 10 years<\/strong>, except for special regimes): legal action, a request for &#8220;continuation&#8221; of the credit, or acknowledgment of the debt can interrupt it, while a request from the company or a letter from a lawyer alone is not sufficient.<\/li>\n<\/ul>\n<p>In summary: <strong>creditors should take legal action when they have evidence of their claim, a concrete prospect of recovery (assets), and the expected cost\/time is justified<\/strong>; before doing so, however, it is recommended to first attempt structured out-of-court pressure by instructing a lawyer to seek payment of the outstanding receivables.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mexico is a rapidly growing market, with approximately 130 million inhabitants and a significant share of foreign product imports, with a range of products destined for both the B2B sector (often with the US market as their final destination) and end customers.
